Please read these terms carefully before using NetworkingWala.in. By accessing or using our platform, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
1. Definitions
- "Platform" refers to the website NetworkingWala.in, its sub-domains, mobile-optimised versions, APIs, and any related digital services.
- "Company", "We", "Us", "Our" refers to NetworkingWala.in, owned and operated by Taher Patel (sole proprietorship), registered in Maharashtra, India.
- "User", "You", "Your" refers to any individual or entity that accesses, browses, or uses the Platform.
- "Products" refers to networking hardware and software items listed on the Platform for sale or inquiry.
- "Services" refers to all services offered through the Platform, including product comparison, e-commerce, IT consulting, network installation, AMC contracts, and community forums.
- "Content" refers to all text, images, reviews, forum posts, product specifications, and other material on the Platform.
- "Order" refers to a request by a User to purchase one or more Products through the Platform.
2. Eligibility & Account Registration
- You must be at least 18 years of age or the age of majority in your jurisdiction to use this Platform.
- By creating an account, you represent that all information provided is accurate, current, and complete. You agree to update such information to maintain its accuracy.
- Email verification via OTP (One-Time Password) is mandatory during registration.
- You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- You agree to notify us immediately of any unauthorised use of your account at connect@networkingwala.in.
- We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.
- Users may register as Customers or Partners (vendors/service providers). Different terms may apply to each role.
3. Products & Pricing
- All product prices are listed in Indian Rupees (₹) by default. Multi-currency display is available for reference but actual transactions are in INR.
- Prices displayed include applicable taxes unless explicitly stated otherwise. GST invoices are available for B2B customers on request.
- Prices, availability, and specifications are subject to change without prior notice.
- We make every reasonable effort to display accurate product information. However, product specifications are sourced from manufacturers and we do not guarantee their accuracy. Please refer to our Disclaimer for more details.
- Products marked as "Inquiry Only" are not available for direct purchase and require a formal quotation process.
- Products marked as "Direct Sale" may be purchased directly through the Platform via Cash on Delivery.
- Product availability is subject to stock levels and may change at any time without notice.
- In the event of a pricing error, we reserve the right to cancel orders placed at the incorrect price and will notify you of the same.
4. Orders & Payment
- Placing an order constitutes an offer to purchase; it does not guarantee acceptance. We reserve the right to accept or decline any order at our discretion.
- An order is confirmed only upon receipt of an order confirmation email from us.
- Currently, we support Cash on Delivery (COD) as the primary payment method. Additional payment methods may be introduced in the future.
- Coupon codes and promotional discounts are subject to specific terms, expiry dates, and usage limits. We may revoke or modify coupon codes at any time.
- We reserve the right to cancel orders due to: pricing errors, stock unavailability, suspected fraud, failure to verify customer details, or delivery address issues.
- Order confirmation, status updates, and invoices will be sent to your registered email address.
- For bulk or enterprise orders, separate terms may apply. Contact us for custom quotations.
5. Shipping & Delivery
Please refer to our Shipping Policy for detailed information on delivery timelines, charges, coverage, and tracking.
- We ship across India through our logistics partners.
- Delivery timelines are estimates and not guarantees. Delays may occur due to factors beyond our control.
- Risk of loss and title to Products passes to you upon delivery to the shipping carrier.
6. Returns & Refunds
Please refer to our Refund & Return Policy for detailed information. Key highlights:
- Returns are accepted within 7 days of delivery, subject to eligibility conditions.
- Refunds are processed within 7-10 business days after inspection of the returned product.
- Orders can be cancelled before they are shipped; shipped orders must follow the return process.
7. Warranty & AMC Contracts
- Products carry manufacturer warranty as specified on the product page. NetworkingWala.in is not the warrantor unless explicitly stated.
- Warranty claims must be processed through the original manufacturer unless a different arrangement is specified.
- Annual Maintenance Contracts (AMC) are available for select products and services. AMC terms, scope, duration, and pricing are governed by the specific AMC agreement signed between you and NetworkingWala.in.
- AMC contracts provide scheduled maintenance, priority support, hardware replacement (subject to terms), and performance monitoring.
8. Professional Services
NetworkingWala.in offers the following professional services:
- Network Design & Architecture: Site surveys, topology design, bandwidth planning, and hardware recommendations.
- Installation & Deployment: Router, switch, WiFi, firewall, and structured cabling installation.
- Firewall & Security: Firewall deployment, VPN configuration, IPS/IDS setup, and security audits.
- Cloud & SD-WAN: SD-WAN deployment, cloud migration, and multi-site connectivity.
- IT Consulting: Vendor comparison, cost optimisation, technology roadmap, and compliance consulting.
Service-specific terms:
- All services are subject to a formal quotation and mutual agreement (estimate) before commencement.
- Service delivery timelines are estimates. Delays caused by client-side dependencies (access, approvals, infrastructure) do not constitute a breach by us.
- NetworkingWala.in shall not be liable for any consequential damages arising from service delivery, including but not limited to loss of data, network downtime, or business interruption.
- Any intellectual property created during service engagements belongs to the client upon full payment, unless otherwise agreed.
9. User-Generated Content
- By posting reviews, comments, forum discussions, or any content on the Platform, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, reproduce, modify, and distribute that content in connection with our services.
- You represent and warrant that you own or have the necessary rights to post such content.
- You must not post content that is:
- Defamatory, obscene, hateful, discriminatory, or threatening
- Infringing any intellectual property or third-party rights
- Spam, advertisements, or promotional material
- False, misleading, or designed to defraud
- Containing malware, viruses, or harmful code
- Community posts are subject to moderation and approval before publication.
- We reserve the right to remove, edit, or refuse any user content at our sole discretion without notice.
- We are not responsible for user-generated content and do not endorse any opinions expressed by users.
10. Product Comparison & Information
- The product comparison feature is provided for informational purposes only. Specifications are sourced from manufacturer datasheets and third-party sources.
- We do not guarantee the accuracy, completeness, or timeliness of comparison data.
- Product comparisons should be used as a guide only — you should verify specifications with the manufacturer before making purchase decisions.
- Comparisons can only be made between products in the same category.
11. Referral & Loyalty Programme
- The referral programme allows users to invite others and earn rewards. Specific reward amounts, eligibility criteria, and expiry terms are displayed on the referral page.
- Loyalty points are earned through qualifying purchases and activities as defined on the Platform.
- We reserve the right to modify, suspend, or terminate the referral and loyalty programmes at any time.
- Abuse of the referral programme (e.g., self-referral, fake accounts) will result in forfeiture of rewards and potential account suspension.
- Rewards and loyalty points have no cash value and cannot be transferred or sold.
12. Newsletter & Communications
- By subscribing to our newsletter, you consent to receiving periodic emails about product updates, promotions, industry news, and company announcements.
- You may unsubscribe at any time using the link provided in every email or by contacting us.
- Transactional communications (order confirmations, account updates, security alerts) are not considered marketing and will be sent regardless of newsletter preferences.
13. Intellectual Property
- All content on this Platform — including text, images, logos, product descriptions, design, layout, code, and graphics — is the property of NetworkingWala.in or its licensors and is protected under applicable Indian intellectual property laws.
- Product names, brand logos, and trademarks displayed on this Platform are the property of their respective owners. Their presence does not imply endorsement by or affiliation with NetworkingWala.in.
- You may not copy, reproduce, distribute, transmit, display, modify, or create derivative works from any part of this Platform without our prior written consent.
- Limited licence is granted to view and print pages for personal, non-commercial use only.
14. Prohibited Activities
You agree not to:
- Use the Platform for any unlawful purpose or activity
- Attempt to gain unauthorised access to any part of the Platform or its systems
- Interfere with or disrupt the Platform's infrastructure, security, or functionality
- Scrape, crawl, or extract data from the Platform without written permission
- Impersonate any person or entity, or falsely claim an affiliation
- Transmit any virus, malware, or harmful code
- Engage in price manipulation, fake reviews, or any form of fraud
- Use automated systems (bots, scripts) to access the Platform without authorisation
15. Limitation of Liability & Indemnification
- The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
- To the maximum extent permitted by law, NetworkingWala.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- Our total aggregate liability for any claim arising out of or relating to your use of the Platform or purchase of Products shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
- You agree to indemnify, defend, and hold harmless NetworkingWala.in, its owner, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.
16. Dispute Resolution & Governing Law
- These Terms shall be governed by and construed in accordance with the laws of India.
- Any dispute arising out of these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.
- If negotiation fails, the dispute shall be referred to mediation in accordance with the Mediation Act, 2023.
- If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.
- Nothing in these Terms shall restrict your rights under the Consumer Protection Act, 2019 or any other applicable consumer protection legislation.
17. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
- Entire Agreement: These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and NetworkingWala.in.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
- Force Majeure: We shall not be liable for any delay or failure in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, supply chain disruptions, or internet outages.
18. Changes to These Terms
We may modify these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Material changes will be communicated via email to registered users. Continued use of the Platform after any changes constitutes your acceptance of the new Terms. If you do not agree with the modified Terms, you must discontinue use of the Platform.
